Insist on them watching YOU repro the problem, and try it several times with the service manager there watching you. Of course, Murphy will probably come into play, but it's worth a shot.
The service techs usually only try ONCE to repro something. They'd much rather say "no repro" and do no work rather than have decent customer service. So you have to make them watch you do it. Then, if it happens, you can make them document that they saw the problem, so if they don't fix it the first time it shouldn't be a "could not reproduce" problem.
Have I mentioned before that I hate Nissan service departments?
