Problem Purchasing wheels. - Click HERE for Original Thread

Hi fellas, I just ran into a huge road block and I don't know were to turn to. I'm hoping with the great minds of this forum, I may find a solution. Here we go:
On 2/18/03 I called Dynamic Wheels.com to find out about the availability of a set of rims called Veloche Jagged 20". As I was talking to this guy named "eddie" he started telling me about how hot these rims are and that they were going to discontinue them soon. Maybe it was a ploy or a sales tactic but I fell for it. I was going on a cruise with my wife the next week so I new that buying these rims now was pushing it. They were going to run me $2195 so I wasn't planning on buying them now. But if there was a chance that they might not be available, I didn't want to miss out on the chance to buy these smoking wheels. "eddie" suggested that I put a partial downpayment of $200, so I did.
When I came back, I was surfing the web and found a different set of wheels that I liked that cost much less (Foose Spank 5 -18") so I bought them. I later called Dynamic Wheels to have them refund my initial $200 deposit and they said that cancelling would result in a 25% service charge on the TOTAL value of the item. That means I need to give them an additional $235 to cancel my order.WTF!!!!
I immediately called Chase Master card and disputed the charges. I explained to them (via letter) that I received NO product, NO services were rendered. I got nada, zilch, zero for Dynamic wheels to keep my money. Chase wrote back to me that it was "my responsibility to know the return policies of the merchant".What?!!!
I wanted to talk to someone higher-up but the rep said that Chase has to follow the rules of Master Card. Now What??
Dynamic won't reverse the charge, Chase won't help me, and I'm supposed to just grin and bare it. No F*&%#ing way.
I need input folks, any help would be appreciated. Thanx....

$2195 for a set of ANY wheels seems like a stretch.....

OK here's the best and easiest way to deal with it.

Give up the $200 and call it "tuition" for the school of hardknocks.
It's gone. Finit.

Call Chase and make sure they will not honor any additional charge from these people.If they won't promise that, cancel the card . You need to do this in writing- ASAP.

Then, and only then, call Dynamic Wheels, who are a California firm, and invite them to come to NY and sue a Goomba, in a NY court, with a NY judge and a NY jury based on the fact that there were no services, products, etc, if they really want the additional $235.
Otherwise they can stuff it.
Don't negotiate with them. Give them no additional information.
That will be the last you ever hear of them.

And the next time you give $200 to a stranger, ask yourself how you are gonna get it back should you change your mind.
It might lead to not giving the stranger the $200, and that's good thing, as Martha would say.

I think I might call Chase one more time (even though I have found them to be ugly as well) and tell them you are canceling their card AND transfering your balance to another card if they do not side with you. I imagine it may make them stop and think....for a few seconds. If it doesn't get their attention, cancel and transfer immediately. I hate to say it, but it worries me that the wheel company just may go ahead and ship which then would make you liable for the extra money. Send them an email copying Chase that you do not want the wheels shipped and will not be responsible for the return fee if they do, put in a line that says "this is a legal notice"---to try to cover that end of it. Emails are legal documents in these matters, but I would also send them an overnight return receipt requested snail mail to back it up.

I might also tell them that your internet presence is prolific on forums where people go to check out wheels and this story may be posted in said forums if the situation doesn't improve. It may also help to give an attorney $50.00 to give them a call and tell them to back off. If they have not shipped, and you have told them NOT to ship with the return receipt of a letter telling them not to, you will have a legal foot to stand on.

If I were in this situation, I'll be dammed if I wouldn't become a member of every car/wheel forum just to drop a dime on them.

ekaxel, yeah they were expensive but the wheels looked hot.
If I didn't find those Foose wheels, I would definatey have gotten the Veloche wheels.
Anyway, I called Chase one more time and explained that the Better business bureau of Cali have cited this company and fined them $200k for their less then stellar business practice up to and including excessive or unnecessary fees and refund polices. Chase promised me another review of my case. I am currently waiting for their reply. If they don't take any action, then I will transfer my remaining balance to another card company stating my intensions in writing and the reasons why they have lost a customer for life.
Too bad I found out about Dynamic wheels thru the BBB after my problem with them.
