Alternator Failed - Car Broken Into - Click HERE for Original Thread

My alternator failed for the second time (first 21k, second 24k). I was at a Maryland football game and left my car near M&T Bank Stadium because my Murano wouldn't start. I had friends in town and didn't have time to wait around for AAA to come and tow my car (for the second time this summer) back to DC.

Lo and behold, I get back to my car in the morning and the right front passenger window was shattered, my arm rest torn off (they obviously couldn't figure it out, just like every other person that sits on the passenger side), right door dented and windshield cracked. They stole some liquor I had in the car, a backpack, golf clubs and some change. I guess they didn't like my music because they left all my CDs.

So, is Nissan going to pay the $500 deductible I have to pay out to my insurance company to fix everything? Or the higher premiums I'll have to pay?

Granted, I could have had the car towed that night, but I had plans in a city that I don't live in. I was staying in a hotel and was going to move it to the hotel lot. However, the alternator failed (AGAIN) and I was unable to move the car myself.

Has anyone encountered anything similar? I will contact NNA and see if there is something they can do, although, I'm not very optimistic. Perhaps a letter to my local newspaper might do something.

Most warranties will not cover incidental damage. However, laws are different from state to state. It does not cost much to file in small claims court, naming Nissan, dealer, and the stadium as defendants. Not sure about the jurisdiction though. Usually it is more trouble for them to come to court (they cannot send a lawyer and must either come themselves or send a rep) so they may settle with you before it gets there.

When you said you didn't have time to wait for AAA that pretty much answers your question of liability...yours. Should have made the time, at least to get it towed back to the hotel. Sorry for no support here but it was your property and you were responsible for it. Now, if it was parked on private property then you might have a case against the property owner, if it was parked legally. I'm sure NNA is going to be very nice on the phone, but...

Wonder if they replaced your alternator with one of the new ones?

Sucks to hear. There isn't much you can do really. I think you'd have a better chance getting the stadium to cough up money - and we all know how tough that'll be.

I agree. I cannot see how you can say Nissan is liable for the vandalism to the vehicle, since you did have the option to call for a tow that evening and get the car moved to a more secure location. A stadium parking lot would seem one of the least safe locations for parking your car overnight.

Unfortunately the laws regarding liability sometimes defy common sense. Not that I agree with it, but you could be held liable where you would not think you should: People see the ice, know it is slippery, have the option to go around it but instead step on it and slip, and then they sue the home owner - and win. The old lady gets hot coffee, knows it is hot and will burn, knows it is in a cup that is not secure, has the option to put it elsewhere, yet decides to put it between her legs and burns herself.

Maybe brooks did have the option not to leave the car there, but the car would not even be there if the alternator had not been bad. Personally, I would not have left the car there, but it does not mean everyone should have decided the same way. So he should bear some of the blame, but so must Nissan and the stadium.

Just my opinion...:)

Sorry to hear this, hope you get her back soon.

Anyway, when you call NNA, dont mention that you were leaving the Mo there on purpose. Instead, just tell them that you were going to get it towed but you forgot to bring your wallet (no money/credit cards), only driving license. Tell them that you were planning to go home (DC), grap your wallet, call AAA and return to the M&T stadium that same night by getting a ride from a friend but that 'friend' of yours had last minute emergency and change his mind. In the end, you decided to come back in the morning as it was already pretty late in the night (1am). When you came back early in the morning, the car had been broken into.......

I guess we are just old fashion guys........or are we? I think some principles never die. Maybe that is why I get periodically in trouble.....but I do not regret it....
