Well, here is what happened this morning when a *&%[email protected]! dump truck went from the left lane over my Murano trying to make a right turn! Anybody know of any great body shops in the Raleigh area? I want my baby back to new again with factory parts. I am so pissed I can hardly see straight. :3:

Dontcha love skilled drivers?

Nobody was injured, correct?

I would think the dealer would be able to get you back on the road with factory parts.

That's where I would take her.

Nobody hurt except my MO. The driver of the dump truck tried to say that because it was a tight turn she had to "turn wide" to make the turn. The dump trucks back tires were still in the left lane when everything came to rest. It was a bad sound that I will never forget. She ran over the front and kept going, the dump truck wheels scraping/tearing down the side of my MO. Uggh.
:(

The police officer said that the insurance companies would battle it out. No ticket was issued to the dump truck driver. :mad:

Without a ticket that's going to be difficult. Is NC a no-fault state? I hate the stupid no-fault laws because they only benefit those crappy drivers that get into accidents and are at-fault. Good luck and the dealer is probably the best bet. You'll probably have to go through your insurance company for the initial claim though, so you may be at their mercy.

ONE Dumb lazy Cop

Just beacuse it was a "Tight Turn" Love to see the defination of that, it does now allow someone to run into someone else. They can wait until it's clear.

I would file a complaint with the Police department. You sure don't need it on your insurance record. Even if you don't win it could help with your insurance company.

I would only go to the dealer AND request that you be informed as to what they farm out and who bears the ultimate responsibility for your satisfaction.

I WOULD ALSO FILE A COMPAINT WITH THE POLICE DEPT
DON'T LET IT AFFECT YOUR INSURANCE...

IF I WERE YOU, ALSO TAKE PICS OF THE LOCATION
OF THE ACCIDENT...SO YOU HAVE GOOD VIEW JUST IN CASE
ANYTHING TO BACK YOU UP..AND GET A GOOD PIC
OF THE AREA WHERE IT ALL HAPPENED...

I THINK THE CITY SHOULD PAY FOR ALL YOUR DAMAGES TO YOUR MO

Why should the city be responsible for paying for damages? It appears to be the fault of the truck driver.

WELL THE DRIVER WORKS FOR THE CITY, RIGHT?

I THINK BOTH ARE RESPONSIBLE IN A WAY..

THE DRIVER FOR HITTING HIM/HER..

AND THE CITY BECAUSE IT CITY PROPERY..

I JUST THINGK THAT IT WOULD FALL UNDER THE CITIES INSURANCE

The dump truck was an independant. No affiliation with the city. I did however find out that the hauling companies sometimes pay off the police so that there are no claims against them like rocks, logs, etc. falling off the trucks. Just a rumor, but makes sense. I guess in this case there had to be a report. :rolleyes:

I agree that it was very clear that the driver turned into me. I do not agree with the fact that the truck driver was not issued a ticket. If they were, it would have made the claim much easier.

I had a tractor trailer driver ride right over the hood of my car making a right turn one time. he apologized up and down and kept saying that the sun was in my eyes and he couldn't see me (I was sitting still at a stop sign). The cop wouldn't write it up because it was on private property and no one was hurt.

I got the guys company name and insurance blah blah blah... well it turns out he goes back to his terminal (7 states away) and tells them that I drove underneath his truck while he was turning.

My insurance paid for the damages but not the $1000 rental car bill.

Lesson learned on my part because had I thought better about it at the time I would have told him not to move his truck until I took as many pictures as my cell phone camera would hold. Being Mr. Polite and because we were blocking both lanes of traffic I naively allowed him to move his rig out of the road.

Best advice ever, get good pictures of the accident scene because the cops certainly aren't going to help you unless your arm is dangling by a string or someone was drinking.

Just because the cop didn't issue a ticket on the spot doesn't mean that the driver won't get one. When I rear-ended someone on the freeway (11 years ago) and was COMPLETELY at fault, the cop didn't issue me a ticket either. I got one in the mail about a month later.

Sometimes they like to file a report, let it go through some channels to make sure fault is taken care of, THEN issue the ticket.

You can blame her for hitting you.
You can't blame her for continuing on even after contact was made.

You obviously have never driven a dump truck.
They feel and sound like an accident, all the time.

I hope that your insurance co has been notified.
They will push for fault being assigned properly.

Cops don't like to attest to something they didn't see.
Can you blame them?
How does he "know" that you didn't hit the truck while the truck was turning?

In my case, because I was pinned w/ a closed gate 3 feet behind me and a fence 3 feet to my left. It was a reverse entrance, and I had nowhere to go. he turned in to the parking lot instead of waiting for me to exit the driveway in front of him to have a clear path at the gate. I know it's hard to visualize, and not really the point of the thread, but it couldn't have been any more clear to anyone that would have seen pictures (that I didn't take) that he ran over my car.

My point is that if there would be pictures of this scene of megadrivers accident w/ a truck obviously in the wrong lane there would be very little denying who would be at fault. This would go a long way with an insurance company when they dont' have a police report to go on.

It really sucks to have your car bashed up, by the way. I hope all goes well with the insurance and the repairs!

I keep a disposable camera in my car for just that purpose.

I have used the cameras twice. Once when an ice-cream truck hit my last car while it was legally parked. And the other time I took pictures of an accident that I witnessed and gave the camera to the person who was hit. They were very grateful and offered me $50 for the camera (I gave it to them for nothing).

Plus there was this one time when these two girls... Oops, wrong forum. :D

About 20 years ago...

I was sitting in the left turn lane not even moving and a dirt hauler had to make a "Wide turn" also to go to the left and ran over my back rear end totaled m car. They claimed that I had ran into them. Pretty neat considering that I was sitting still and they ran over the back end of my car. They took me to court for hitting their truck. I fortunately had 3 not 2 but 3 independent witnesses. The truck driver got so mad in court and threatened me from the stand, the judge first admonished him and then he got even madder and then the judge had the bailiff arrest him on the spot. I was awarded 100% Plus given punitive damages as compensation for being taken to court on a civil suit over a false claim on a traffic violation, for my time. I had never heard of such a thing but it happened. Finally the judge issued a bench restraining order against the truck driver and the companies personnel because of the " I'll beat up to a pulp" exclamation of the truck driver. They had to stay at leadt 500 feet away from me and my work place and residence.

I must say since he out weighed my by at least 60 pounds, 20 tattoos and I was 20 years older than him it did make me feel better. However I was looking over my shoulder for a number of months.

I could never figure out just why all the anger until much later I found out that the driver have so many tickets he lost his commercial license over it.

I enjoyed your story. It is very satisfying to read an account where the person responsible for an accident is given his just desserts. Too many times those responsible are simply allowed to walk away without so much as an apology.

Sorry about the accident, We got clobbered by a Raleigh Police car. At the time the City of Raleigh had immunity to law suits...what a pain THAT was!

What a great idea. I think I'll join that club, Immunity against lawsuits neato. I hereby give public notice that I can no longer be sued. :2: :2: :2: :2: :2:
